Acceptance of Terms

Welcome to GoPC. GoPC Pty Ltd (“GoPC”) provides its service to customers subject to the following Terms of Service (“TOS”). GoPC reserves the right, at its complete discretion, to revise these terms and conditions at any time by posting new/revised terms on the Site. Your continued use of this site and the GoPC service following the posting of changes to these terms and conditions means you accept the changes. It is your responsibility to check periodically for any changes which may be made to these terms and conditions of service.

Description of Service

GoPC currently provides users with access to a rich collection of on-line resources and applications, including various communications tools, email services, web browsing and file storage/sharing services (the “Service”). Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new GoPC properties, shall be subject to the TOS. You understand and agree that the Service is provided “AS-IS” and that GoPC assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings. In order to use the Service you must obtain access to the Internet, either directly or through devices that access Internet services, and pay any service fees associated with such access. In addition you must provide all equipment necessary to make such connection to the Internet, including a computer and modem or other access device.

Paid Services

Payment for paid services is only by a recurring credit card authority or direct debit authority via PayPal and is charged each period in advance of the service. Unless stipulated, no refund is provided on the service but there is no lock-in contract for a customer and subscriptions can be canceled at any time. You can cancel subscriptions to paid services at any time through your PayPal account at which point no further service will be provided. Customers can upgrade with additional services such as storage space through the Members Area. The company reserves the right to adjust pricing of any services at its discretion.

Free Services

The free service is provided to you without warranty and we reserve the right to withdraw the free service at any time and without prior notice.

No Resale of Service

You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service without the prior consent of GoPC. If your are interested in becoming a GoPC Business Partner, please contact GoPC.

General Practices Regarding Use and Storage

You acknowledge that GoPC may establish general practices and limits concerning use of the Service, including without limitation the maximum number of days that email messages, message board postings or other uploaded Content and/or files will be retained by the Service, the maximum number of email messages that may be sent from or received by an account on the Service, the maximum size of any email message that may be sent from or received by an account on the Service, the maximum disk space that will be allotted on GoPC’s servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Service in a given period of time. You agree that GoPC has no responsibility or liability for the deletion or failure to store any messages and other communications or other Content and/or files maintained or transmitted by the Service. You acknowledge that GoPC reserves the right to disable accounts that are inactive for an extended period of time. You further acknowledge that GoPC reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.

Quality of Services Across The Internet

The GoPC service is transmitted via the Internet. The quality of the customers Internet link is important to the quality of service experienced. This may vary from one location to another, or from one ISP to another. It is the customer’s responsibility to assure adequate bandwidth, connection speed, and latency across the link to the GoPC service. Please check with your Reseller or PC Support person to ensure that you are connecting to the right data centre for your region.

Local Laws

Recognising the global nature of the Internet, you agree to comply with all local laws regarding online conduct and acceptable Content and/or files. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from Australia, New Zealand or the country in which you reside.

How to Get Help and The Boundaries of Responsibility

GoPC is an extremely reliable, state-of-the-art system supporting a large number of concurrent users. If you do experience a problem it is likely the issue may be affected by the number of applications open on your computer or the configuration of your local PC, local network or local Internet connection. The FAQ and On-Line Help address most PC issues encountered by others previously but you can also contact us directly. Depending on your area we may put you in touch with a qualified GoPC support engineer if you need on-site help.

Indemnity and Limited Liability

The customer understands and agrees that:

  • any automated system can be subject to equipment failure, that Internet connectivity is dependent on other third party service providers as well as the customers own equipment.
  • computer security based on software is provided by other third parties without any warranty or guarantee and that security needs to be continually reviewed and updated.
  • any system works in conjunction with other systems and that a system can be compromised through various mechanisms such as network openings, physical office security, actions by internal staff, social engineering and other means.

The Customer acknowledges that GoPC provides the Service as is and with best effort but otherwise takes no responsibility for any loss or damage suffered by the Customer while using GoPC’s systems or services, including as a result of any wilful or negligent act or omission of any GoPC’s officers, employees or agents.

The customer agrees they will regularly check their data recovery procedures, take additional backups of their own data on alternate media regularly as a double protection in the event of a system failure and to perform their own visual checks and regularly test their data recovery capability.

The Customer agrees to irrevocably release GoPC, its officers, employees and agents from any legal claim for breach of contract, breach of statute, negligence, supply of an ineffective service, or any other cause of action whatsoever. Except as provided to the contrary by Legislation, the Customer agrees that GoPC is not under any liability to the Customer in respect of any loss or damage which the Customer may suffer from the provision of the Service or its inability to do so. The Customer irrevocably releases GoPC from any and all claims for any loss of business, personal discomfort or any other damages arising directly or indirectly from or alleged to have arisen from the loss of money, data, corruption of data, or non-provision of services to the Customer or any third party. If by Legislation GoPC is required to give a warranty for the Service then the Customer agrees that GoPC’s liability for any breach of such warranty is limited to (a) the supply of the service again or (b) payment of the costs of supplying the service again in the month when the issue occured. Neither party shall be held liable for any failure or delay in performance which is caused by circumstances beyond the reasonable control of that party including but not limited to: fire, explosion, lightning, pest damage, power surges or failures, strikes or labour disputes, water, acts of God, earthquake, flood, riot, embargo, government act, failure of the Internet, war, civil disturbances, terrorist acts, acts of military authorities, inability to secure raw materials, transportation facilities, fuel or energy shortages, acts of omissions of communications carriers, unauthorised use of the Services, or other causes beyond the party’s control, whether similar to the foregoing or not.

Disaster Recovery, Backup and Restore

The GoPC service is provided on an “as is” basis. We have built in a high level of disaster/recovery capability through redundant hardware and backup systems and do our utmost to provide a totally reliable service. However within the low cost price that we rent the service for we do not provide a guaranteed service. It is a fundamental condition of use that when using the GoPC system the customer understands that it is without guarantee and that they that will not hold GoPC liable for any failure of the service, for any damages to a business or property or person. It is deemed the customer has agreed to these conditions when they activate their account and starting using the service. Unless the customer has specifically purchased a DRP Plan we do not provide a service to individually restore specific data files from backups as it is not practical to provide such a service to very large numbers of users. Instead we provide a service where customers have access to a directory called “Backup” within each storage volume which is a snapshot of data taken roughly 24 hours earlier. The customer can verify their backups are valid and recover individual files or directories with a click-n-drag back to their main storage area. We are scrupulous with our backup systems but do not guarantee these data backups will be available. We recommend customers check their Backup directory regularly and arrange for a special off-site copy of their changed data periodically. This is a simple practical way for customers to double their protection of precious data.

Software Licenses and The Nature of The Service

GoPC as a hosted on-line service providing access to a number of pre-configured software applications for use by individuals. Most of the software applications licenses are Open Source or are paid for by us. We do not sell or license this software to customers. The subscription payments only cover our cost of providing a sophisticated hosting, storage and support service. If a customer installs software with licensing requirements then that customer acknowledges that the company is not responsible for those licenses and the customer themselves is responsible for licenses costs to operate the software legally. GoPC or the company will not accept liability for software license infringements as this is the responsibility of the customer. The customer agrees to use the GoPC service for legitimate and legal purposes only. The customer is subject to the laws of the country in which they operate the system from and the laws of the country in which their GoPC data centre resides. GoPC management reserve the right to suspend a service at its discretion.


A customer’s service may be terminated without refund where a GoPC customer uses the service inappropriately or illegally. We will not allow the system to be used for transmitting unsolicited bulk email (Spam), Ping Floods or any Network Attacks. A service may also be terminated for failure to pay for the service. Should an account be terminated we do not guarantee to retain the end users data and may reclaim this space for another user. It is the customers responsibility to guarantee they have a copy of their data before they cancel the service. GoPC management do not promote or condone illegal acts, such as software or music piracy, and we subscribe to an acceptable use policy equivalent to most educational institutions.

On Usage

We do not recommend GoPC is used for downloading large files such as movies and music. The system architecture is not designed for music or videos which will still need to be downloaded to your local machine to run well. GoPC is ideally suited for doing your work and running your affairs. Most printer types are supported, but please check with the Members Area, your Reseller or support engineer on which printer driver will be most suitable for you.

On Security

We use the highest level of encryption and security technology that we have available to us so that any data traversing the Internet is fully encrypted. Most security risk however is attributed to the way users manage their information and access their accounts. We strongly recommend that our customers never share their account with other people, nor divulge or write down their login details anywhere. We also recommend you check that the GoPC client program on the PC is configured so that it does not have the “Remember Password” checkbox ticked. You can double check this after you’ve logged out by testing the login process again. GoPC is a virus free and spy-ware free environment and as far as we can reasonable anticipate is likely to remain that way for the foreseeable future. Security requirements are constantly changing and as a result we cannot provide a guarantee.
